Programa Acceptable Use Policy
Introduction
This Programa Acceptable User Policy (‘User Guidelines’) includes important information about how Programa defines and maintains acceptable use of the Programa platform, website, products and services (‘Services’). In our mission to build the world’s most innovative software platform for the Architecture and Design Industry, we are highly committed to providing a safe environment and protecting user privacy. Our global teams work hard to protect users of Programa Services from harm, help keep their data safe and ensure the experience is enjoyable for everyone. We may update these User Guidelines from time to time. You can find the latest version on our website.
Why we have User Guidelines
Our purpose is to empower and equip you with the tools and ability to make your own choices with respect to your use of Programa Services. This is how we build and operate our software. As such, we provide you with a set of platform rules or User Guidelines to use or Services. The main rule for using Programa is that you are ultimately responsible for following the rules of your Services, your partners or customers and the law. Depending on which Services you use, you may also be subject to additional requirements.
Principles for when you use the Services
These are the primary principles and expectations for when you use the Services:
- You can not use the Services to do anything illegal where you do business, operate from or reside in. We trust you to understand and comply with your own applicable boundaries and regulatory requirements.
- You can not abuse, breach or undertake any activities that threaten, harass or harm people or other users of the Services.
- You need to follow our agreements with you - such as the Terms of Service or other policies posted on our website. These are all important in explaining how we operate, and what platform rules you must follow.
- Programa offers a range of Services that leverage third party products or partnerships. When you use these products, you are interacting with businesses operating beyond the control of Programa: for example, Programa In App Payments Services involves an ecosystem of processors, card networks, and banks working together. If you use these services, you need to respect how the ecosystems work and what terms are asked of you. These third parties may also apply their own rules to permit or sustain your use.
- Please always act in good faith. If you do not, we may choose to take appropriate user or account level action to mediate this.
- We do not tolerate ‘gaming’ behaviours to avoid any Services constraint that you may not agree with. This includes defrauding Programa or other users, using Programa to send spam, attempt fraudulent payments or act maliciously.
Implications for violating the User Guidelines
Violating the User Guidelines may result in removal of any content you have contributed to the Services and/or termination or suspension of your account. We try to make the Services broadly available to everyone, but you cannot use our Services if we have previously terminated your account on any of our Services. Repeated or egregious violations may result in accounts being suspended and/or terminated. We also prohibit attempts to circumvent prior enforcement actions, including through the creation of new accounts. Programa seeks to enforce these rules consistently and at scale across the world using a combination of technology and human review. In addition to user reports, we leverage automated tools that rely on a combination of signals to detect content that may violate our guidelines. When potentially violating content is reported or detected, our teams will work to take the appropriate enforcement action.
User Guidelines for what is strictly prohibited
The following is not permitted for any reason whatsoever in relation to your use of the Services:
- Reverse-engineering, decompiling, disassembling, modifying, or creating derivative works, except where such restriction is expressly prohibited by applicable law. If applicable law allows you to decompile any part of the Services where required in order to obtain the information necessary to create an independent program that can be operated with the Services or with another program, the information you obtain from such activities (a) may only be used for the foregoing objective, (b) may not be disclosed or communicated without Programa's prior written consent to any third party to whom it is not necessary to disclose or communicate in order to achieve that objective, and (c) may not be used to create any software or service that is substantially similar in its expression to any part of the Services;
- Copying, reproducing, redistributing, "ripping," recording, transferring, performing, framing, linking to or displaying to the public, broadcasting, or making available to the public, or any other use which is not expressly permitted under the Terms of Service or applicable law, or which otherwise infringes intellectual property rights;
- "Crawling" or "scraping", whether manually or by automated means, or otherwise using any automated means (including bots, scrapers, and spiders), to view, access or collect information, or using any part of the Services to train a machine learning or AI model or otherwise ingesting Programa Content into a machine learning or AI model;
- Selling, renting, sublicensing, leasing or other monetisation except as expressly permitted under the Terms of Service;
- Circumventing any technology used by Programa, its licensors, or any third party, including any territorial or other content access restrictions applied by Programa or its licensors;
- Circumventing or blocking advertisements or creating or distributing tools designed to block advertisements;
- Removing or altering any copyright, trademark, or other intellectual property notices;
- Deleting or altering any part of the Services except as expressly permitted under the Terms of Service or, in the case of content made available by another user, without such user's express consent; or
- Providing your password to any other person or using any other person's username and password.
Do not engage in any activity, post any content or register an account which includes material that:
- Is illegal, or intended to promote or commit an illegal act of any kind, including violations of intellectual property rights, privacy rights, publicity rights, or proprietary rights of Programa or a third party, or would violate any agreement to which you are a party;
- Includes your password or purposely includes any other user's password or purposely includes personal data of third parties or is intended to solicit such personal data;
- Exposes confidential or proprietary information of a third party or personal information that is not intended to be broadcast to people around the world;
- Includes malicious content such as malware, Trojan horses, or viruses, or otherwise interferes with any other user’s access to the Services;
- Impersonates or misrepresents your affiliation with Programa, another user, person, or entity, or is otherwise fraudulent, false, deceptive, or misleading. This includes using Programa's copyrighted content, using the Programa logo without permission, or otherwise using Programa trademarks in a confusing manner;
- Involves the transmission of unsolicited mass mailings or other forms of spam, junk mail, chain letters, or similar;
- Unauthorised commercial or sales activities, such as advertising, promotions, contests, sweepstakes, gambling, bookmaking, or pyramid schemes;
- Unauthorised linking to, referencing, or otherwise promoting commercial products or services, except as expressly authorised by Programa;
- Interferes with or in any way disrupts the Services, tampers with, breaches, or attempts to probe, scan, or test for vulnerabilities in the Services or Programa's computer systems, network, usage rules, or any of Programa's security components, authentication measures or any other protection measures applicable to the Services or any part thereof;
- Conflicts with the Programa Terms of Service or any other terms or policies applicable to your use of any of the Services; or
- Has been removed from any of our services for a breach of our terms or policies. This includes content being created or repurposed to reconstitute or serve the same objective as previously removed content.
Rules for user-generated content
Programa insists that users are careful with the content or materials that they create, upload or share via the Programa Services:
Dangerous Content
Do not upload or share any content in our Services that promote violence, incite hatred, harass, bully, or engage in any other behaviour that may place people at risk of serious physical harm or death.
Deceptive Content
Creating great experiences on Programa requires trust that people are who they say they are, that they won't be scammed and that no one is trying to manipulate our platform. Do not use malicious practices to deceive others.
Sensitive Content
There are certain things that we don't allow on our platform. Do not post excessively violent or graphic content, and don't post sexually explicit content.
Illegal Content
The law is the law. It is your responsibility to comply with applicable laws and regulations.
